Peace of Mind travel-assistance service
1. Who we are and scope of this policy
Réclamation vol en retard inc. / Late Flight Claim Inc. ("FlightClaim," "we," "us" or "our") operates the Peace of Mind / La Paix d’Esprit travel-assistance service available at peaceofmind.travel and through our partners. Peace of Mind monitors your flights in real time, informs you of your air-passenger rights, and, when a covered disruption occurs, automatically files a compensation claim with the airline on your behalf.
This Privacy Policy explains what personal information we collect, why we collect it, how we use and share it, how long we keep it, and the rights you have. It applies to our website, our SMS and email notifications, and the claim-handling services provided under the Peace of Mind program. It supplements, and should be read together with, the Peace of Mind Program Terms and Conditions.
FlightClaim acts as the party responsible for (controller of) the personal information described here. Our head office is located at 4905, boul. Lapinière, Suite 3200, Brossard (Québec) J4Z 0G2, Canada.
2. Personal information we collect
We collect only the personal information reasonably necessary to provide the Peace of Mind service and to pursue compensation claims on your behalf. Depending on how you use the service, this may include:
Information you provide to us
Identity and contact details: first and last name, email address, mobile phone number, postal address, and preferred language.
Travel and flight details: booking or reservation references, flight numbers, airlines, dates and times, itineraries, departure and arrival airports, ticket class, and the number and identity of accompanying travellers covered under a family plan.
Claim-support documentation: boarding passes, e-tickets, booking confirmations, receipts for expenses (meals, accommodation, transport), correspondence with the airline, and any other document needed to substantiate a claim.
Payment and disbursement details: information needed to collect the subscription fee and to remit compensation to you, such as bank-transfer (Interac) details or the mailing information required to issue a cheque. Card payments are processed by our third-party payment processors; we do not store full card numbers.
Communications: the content of messages, calls, and support requests you send us.
Information we collect automatically
Flight-status data: real-time flight monitoring information obtained from aviation data providers in relation to the flights you register.
Technical and usage data: IP address, device and browser type, operating system, pages viewed, and similar information collected through cookies and comparable technologies on our website. See Section 8 (Cookies).
Information from third parties
Partners and distributors: where you subscribe to Peace of Mind through a travel agency, insurer, credit-card program, or other partner, that partner may transmit to us the identity, contact, and flight information needed to activate your coverage.
Aviation and regulatory data sources: flight-tracking services and publicly available regulatory information used to assess eligibility under applicable air-passenger regulations.
We do not knowingly collect sensitive personal information (such as health, biometric, or financial-account credentials beyond what is described above) and we do not require it to provide the service.
3. Why we use your personal information
We use your personal information for the following purposes:
To provide the Peace of Mind service: monitor your registered flights, send you real-time notifications by SMS and email, and inform you of your rights when a disruption occurs.
To file and manage compensation claims: analyze whether your disruption is eligible, prepare and submit a claim to the airline, communicate and negotiate with the airline and any out-of-court or judicial body, and collect and remit any compensation obtained, under the Canadian Air Passenger Protection Regulations (APPR), EU Regulation 261/2004, the Montreal Convention, U.S. DOT regulations, or any other applicable law.
To administer your subscription: process payment of the subscription fee, manage your account, transfer coverage to a new flight at your request, and provide customer support.
To communicate with you: respond to your inquiries, send service-related messages, and, where permitted, send you information about our services (you may opt out of marketing at any time).
To improve and secure our service: analyze usage on an aggregated basis, prevent fraud and abuse, and maintain the security and integrity of our systems.
To comply with legal obligations: meet our obligations under applicable laws, respond to lawful requests from authorities, and establish, exercise, or defend legal claims.
Under Quebec law we rely primarily on your consent and on the necessity of performing the contract between you and FlightClaim. Where the EU General Data Protection Regulation (GDPR) applies, our legal bases are the performance of our contract with you, your consent, our legitimate interests in operating and improving the service, and compliance with legal obligations.
5. International transfers of personal information
FlightClaim is based in Quebec, Canada, and stores information primarily in Canada. Because we pursue claims under Canadian, European, U.S., and other regulations, and because some of our service providers operate outside Quebec, your personal information may be transferred to, accessed from, or stored in jurisdictions outside your province or country of residence — including elsewhere in Canada, the United States, and the European Union.
Before disclosing personal information outside Quebec, we conduct a privacy impact assessment as required by Quebec law and put in place appropriate contractual and security safeguards. Where the GDPR applies to a transfer outside the European Economic Area, we rely on recognized transfer mechanisms such as the European Commission’s Standard Contractual Clauses or an adequacy decision.
6. How long we keep your personal information
We keep your personal information only for as long as necessary to fulfil the purposes described in this policy, including providing the service, pursuing and closing your claim, meeting our legal, accounting, and tax obligations, and establishing or defending legal claims.
In practice, active flight-monitoring data is retained for the duration of the covered trip; claim files and related documentation are retained for the period during which a claim may be brought, contested, or audited under applicable limitation periods, and for a reasonable period thereafter. When personal information is no longer needed, we securely destroy it or anonymize it in accordance with our retention schedule.
7. Your rights and choices
Depending on where you live, you have some or all of the following rights over your personal information:
Access: obtain confirmation that we hold information about you and receive a copy of it.
Correction (rectification): have inaccurate, incomplete, or outdated information corrected.
Withdrawal of consent: withdraw your consent to a particular use or disclosure, subject to legal or contractual restrictions. This may prevent us from continuing to provide the service.
Deletion / de-indexing: in certain circumstances, request that we delete or cease disseminating your information, or de-index a link to it.
Portability: where the law provides, receive the computerized personal information you provided to us in a structured, commonly used technological format.
Objection and restriction: where the GDPR applies, object to or request restriction of certain processing.
Complaint: lodge a complaint with a supervisory authority (see Section 11).
You can also opt out of marketing communications at any time by using the unsubscribe link in our emails or by replying STOP to an SMS. To exercise any right, contact our Privacy Officer using the details in Section 11. We will respond within the timeframes required by applicable law (generally 30 days under Quebec law).
9. How we protect your personal information
We implement reasonable administrative, technical, and physical safeguards designed to protect your personal information against loss, theft, and unauthorized access, disclosure, copying, use, or modification. These include access controls on a need-to-know basis, encryption in transit, confidentiality obligations for staff and providers, and monitoring of our systems. No method of transmission or storage is completely secure; in the event of a confidentiality incident presenting a risk of serious injury, we will notify affected individuals and the relevant authorities as required by law.
10. Children’s privacy
The Peace of Mind service is intended for adults. Where a family plan covers children, the subscribing adult provides and is responsible for the children’s information. We do not knowingly collect personal information directly from children without the involvement of a parent or guardian. If you believe a child’s information has been provided to us improperly, please contact our Privacy Officer.
11. Contact us and how to make a complaint
FlightClaim has designated a Privacy Officer responsible for the protection of personal information and for handling access, correction, and complaint requests. You can reach us as follows:

If you are not satisfied with our response, you may contact the Commission d’accès à l’information du Québec (CAI) or the Office of the Privacy Commissioner of Canada. If you are located in the European Union or United Kingdom, you may also contact your local data-protection authority.
12. Changes to this policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, or legal requirements. When we make material changes, we will update the effective date below and, where appropriate, notify you. The version in force is the one published at peaceofmind.travel. In the event of any discrepancy between the French and English versions, the French version prevails.
